Senate Dems give way to GOP to end FAA shutdown (AP)

WASHINGTON ? With tens of thousands of jobs, more than $1 billion and their reputations on the line, Senate Democrats gave way Friday to a power play by House Republicans in order to end a partial two-week shutdown of the Federal Aviation Administration.

With lawmakers scattered for Congress' August recess, the consent of only two senators was required to pass a bill restoring the FAA's operating authority through Sept. 16. President Barack Obama signed it into law hours later. But partisan differences remain, and a repeat performance of the legislative standoff could come next month.

The impasse had left hundreds of airport construction projects in limbo and idled tens of thousands of construction industry workers as well as nearly 4,000 FAA employees.

One of the biggest costs was to the hard-pressed U.S. treasury, which lost about $400 million in uncollected taxes during the two-week standoff and stood to continue losing $30 million a day ? more than $1 billion in total ? if there had been no solution before Congress returns from its recess.

For most of the stalemate, the nation's attention ? and that of Congress ? was riveted on the debt crisis finally tackled this week.

But that quickly shifted. Lawmakers were getting calls about unfinished airport towers and construction companies in dire straits at home. Some unemployed workers found their way to Capitol Hill to complain.

Democrats had been holding firm against the House legislation on FAA operations because it proposed cutting air service subsidies to 13 rural communities. In short, they feared getting steamrolled on similar legislation in the future if they gave Republicans their way. For example, spending authority for federal highway programs expires Sept. 30, another possible point of contention.

But once the focus fell away from the deal to avert a federal debt default, Democrats began to waver and finally gave up the fight.

Republicans achieved the subsidy cuts in the final law but with a major caveat. Transportation Secretary Ray LaHood has the authority to continue subsidized service to the 13 communities if he decides it's necessary.

Obama's signature means the nearly 4,000 furloughed FAA employees can return to work as soon as Monday. Work can also resume on more than 200 airport construction projects.

"This impasse was an unnecessary strain on local economies across the country at a time when we can't allow politics to get in the way of our economic recovery," Obama said in a statement.

Republican Rep. Tom Price of Georgia, chairman of the House Republican Policy Committee, said the FAA partial shutdown was "emblematic of the type of inaction and politics-come-first attitude we have seen from Senate Democrats all year."

Bill Samuel, the AFL-CIO's legislative director, saw the dispute differently. He said Republicans were willing to keep pushing their agenda at the expense of jobs and air safety.

"I think they're getting reckless," Samuel said in an interview. "Maybe with each victory they decide they can push a little farther."

With the standoff on the nation's radar screen so briefly, it's hard to know whether either party will suffer political damage, said Norman Ornstein, an expert on Congress with the American Enterprise Institute. It could end up as another example of the public declaring a pox on both their houses.

"Voters hate this stuff," he said. "They hate the damage...the dysfunction."

Both the House and Senate passed long-term financing bills for the FAA earlier this year, but negotiations on resolving differences and completing the legislation remain stalled. That's what made a short-term extension of spending authority necessary.

The agency has been operating under a series of 20 such extensions since 2007, when the last long-term FAA financing bill expired.

The biggest holdup is a labor provision in the House bill. Republicans want to overturn a National Mediation Board rule approved last year that allows airline and railroad employees to form a union by a simple majority of those voting. Under the old rule, workers who didn't vote were treated as "no" votes.

Airline passengers in the busy travel season hardly noticed any of the changes over the two weeks.

Airlines continued to work as normal, but were no longer authorized to collect federal ticket taxes. For a few lucky ticket buyers, prices dropped. But for most, nothing changed because airlines raised their base prices to match the tax.

Communities targeted for the proposed air service subsidy cuts are Morgantown, W.Va.; Athens, Ga.; Glendive, Mont.; Alamogordo, N.M.; Ely, Nev.; Jamestown, N.Y.; Bradford, Pa.; Hagerstown, Md.; Jonesboro, Ark.; Johnstown, Pa.; Franklin/Oil City, Pa.; Lancaster, Pa.; and Jackson, Tenn.

Cuba upholds jailed American's 15-year sentence (AP)

HAVANA ? Cuba's Supreme Court on Friday rejected a U.S. government subcontractor's final legal appeal of his 15-year prison sentence for crimes against the state.

Alan Gross' request to have his sentence reduced or thrown out was denied in a "definitive resolution," a note on state-run website Cubadebate said.

Gross has been behind bars since his arrest in December 2009, and this spring he was found guilty of bringing satellite and other communication equipment into the country illegally.

The Maryland native has acknowledged he was working on a USAID-funded democracy program, but says he meant no harm to the government.

"While we are not surprised, we are extremely disappointed with today's ruling, which marks the end of Alan's legal process in Cuba," Gross' U.S. lawyer, Peter J. Kahn, said in a statement. "The family is heartbroken by today's decision, but remains hopeful that there continues to be room for a diplomatic resolution of this matter."

U.S. officials have said they did not expect the court to throw out Gross' conviction, but have held out hope that the end of the legal process might clear the way for his release on humanitarian grounds. Gross, 62, has lost 100 pounds (45 kilograms) in jail by his own estimation, and several family members in the United States have serious illnesses.

Cuban officials have said privately they are sympathetic to humanitarian appeals, but would not consider them until the Supreme Court ruled.

"Entering his 21st month in a Cuban prison, Alan and the entire Gross family have paid an enormous personal price in the long-standing political feud between Cuba and the United States," Kahn's statement continued. "Now, more than ever, we call upon the two countries to resolve their dispute over Alan's activities diplomatically, and request that President Raul Castro release Alan immediately on humanitarian grounds."

(AP) ? Kaltum Mohamed sits beside a small mound of earth, alone with her thoughts. It is her child's grave ? and there are three others like it.

Just three weeks ago, Mohamed was the mother of five young children. But the famine that has rocked Somalia has claimed the lives of four of them. Only a daughter remains. The others starved to death before Mohamed's eyes as she and her husband trekked to Somalia's capital, Mogadishu, in search of aid.

Thousands of parents are grieving in Somalia and in refugee camps in neighboring countries amid Somalia's worst drought in 60 years.

The drought and famine in Somalia have killed more than 29,000 children under the age of 5 in the last 90 days in southern Somalia alone, according to U.S. estimates. The U.N. says 640,000 Somali children are acutely malnourished, suggesting the death toll of small children will rise.

Mohamed and her husband tried to get their children from Somalia's parched south to the capital, Mogadishu, in time to receive emergency aid from the few humanitarian organizations that are operating there. They began their journey in the Lower Shabelle region, where the U.N. declared famine July 20. AP Television News found her that day looking after her severely malnourished children, cradling them in her arms.

Her family belongs to a tribe of pastoral nomads, but all of their livestock died in the drought. When her children fell ill, she took them to a hospital in the Lower Shabelle but couldn't afford the treatment they needed. Most aid is not getting to the south where it's desperately needed. An al-Qaida allied group, al-Shabab, controls much of southern Somalia and insists that there is no famine. It has banned all aid groups but the International Committee of the Red Cross.

The family's journey to the capital, one being made by thousands of other Somalis, came too late. Four of Mohamed's children died en route because of severe malnutrition and related complications.

"Death is inevitable," Mohamed told AP Television News on Thursday in a makeshift camp near Mogadishu's airport, home to hundreds of other displaced people. "But the surprise was how suddenly I lost my four children in less than 24 hours because of famine."

Instead of being able to caress her children, she crouched next to one of their graves and softly patted and smoothed the mound of earth covering it. She wept, then wiped away her tears. She still has a daughter to try to feed.

The Muslim holy month of Ramadan is under way, and the family is fasting daily. Without food, though, Mohamed doesn't know how they can break their fast at sundown. The international community must do more to help, she said.

Meanwhile, famine still stalks her.

On Wednesday, the U.N. declared three new regions in Somalia famine zones ? including the camps for displaced persons in Mogadishu. These are areas where the highest rates of malnutrition and mortality are taking place.

Nancy Lindborg, an official with the U.S. government aid arm, told a congressional committee in Washington on Wednesday that the U.S. estimates that more than 29,000 children under the age of 5 have died in the past 90 days. That number is based on nutrition and mortality surveys verified by the U.S. Centers for Disease Control and Prevention.

A U.S. official noted Thursday that the U.S. said this week it would not prosecute legitimate aid groups trying to assist Somalis suffering from famine in areas under al-Shabab control. Such prosecution would have been possible under U.S. anti-terrorism laws, but getting groups to go into a part of Somalia controlled by a brutal, hardline Islamist insurgency is another matter.

The official, Jon Brause of USAID, told journalists in Nairobi, Kenya, that there hasn't been a dramatic increase in assistance flowing to Somalia after the announcement because it's so difficult to access al-Shabab-controlled territory.

No U.S. law specifically prevents aid to southern and central Somalia, where the U.N. food agency says it cannot reach 2.2 million Somalis in areas under al-Shabab's control. But bribes, tolls and other typical of costs of doing business in the largely lawless and chaotic country could have been punishable after the State Department declared al-Shabab a terrorist organization in 2008.

"We understand that some assistance may accidentally reach al-Shabab and we are reassuring people they will not suffer prosecution if that happens," said Bruce Wharton, the deputy assistant secretary of state for African affairs.

Wharton signaled that the U.S. believes some inside al-Shabab might be more amenable to letting aid in than others.

"We do not believe al-Shabab is a monolithic organization," he said. "There are degrees of Shabab-ness, if you will, and we think it's important to find ways to get food to people, including people who are in al-Shabab controlled territories."
