One of the most bizarre stories of the 2010 season came from the discovery of online foot-fetish photos and videos featuring the wife of Jets coach Rex Ryan.? The coach who generally talks about anything and everything consistently slammed the door on this particular topic, calling it a personal matter until the media stopped asking about it.

It has since bubbled up once or twice, thanks to (for example) Patriots receiver Wes Welker, who was benched at the outset of the playoff game between the two teams after making a string of snarky remarks about the subject to the press.

Months later, at a time when the issue was otherwise dead, it has again been dusted off.? This time, the offender was the man who once shared a womb with Rex.

Cowboys defensive coordinator Rob Ryan sounded off on the issue in the Cowboys? locker room on Monday, according to Clarence E. Hill, Jr. of the Fort Worth Star-Telegram.

?Aw hell who cares,? Rob Ryan said of Rex, six days before the Cowboys and the Jets square off on NBC?s Sunday Night Football.? ?Believe me, everybody has whatever screwed up thing going on.? I don?t care.? I?m sure you do, and everybody else that points fingers.? Who cares?? Everybody has a life off the field.? Who gives a crap?? I?m sure I?m worse than he is.? So big deal.?

As Hill astutely points out, Rob Ryan?s comments provide something that neither Rex nor the Jets had ever supplied:? Confirmation.

?Naw, I mean hell, he is a little freaky I guess,? Rob Ryan said.? ?Hell, I don?t know.? I like everything about my wife.? She got great feet, too.? She got everything nice.? What the hell.?

Rob surely meant no harm; in a roundabout way, he was trying to help Rex.? Still, it remains to be seen whether Rex will be upset with his twin brother ? and, if he is, whether Rex will make that known to the media, or to anyone.? (Or guess is that, when Rex is asked about his brother?s comments, Rex will say what he said last year.? Nothing.)

At a time when the Ryans? coaching abilities and bravado have largely overcome the perception that they are wired to say too much, Rob may have harmed his ability to become a head coach by committing the kind of indiscretion that could make it even harder for an owner to entrust Rob Ryan to be the face and voice of an NFL franchise.? With that job comes access to all sorts of franchise secrets.? If Rob doesn?t know when to say ?no comment,? he may not be deemed worthy to hold the kind of position that Rex has achieved.

Eddie Murphy high on list to host Oscars: report (Reuters)

NEW YORK (Reuters) ? Comedian Eddie Murphy is on an Oscar producer's shortlist to host the Academy Awards in February, showbusiness website Deadline reported.

A meeting is scheduled for this coming Tuesday between Oscar producer Brett Ratner and the Academy of Motion Picture Arts & Sciences, at which Ratner will offer president Tom Sherak the idea of having Murphy host the world's top film honors.

Deadline, citing unnamed sources, said in a report on Saturday night that having the "Shrek" movie star host the show was not a done deal, with many more steps to be completed before Murphy is agreed upon.

The 84th Academy Awards' other producer, Don Mischer, has been approached by several other big names who have expressed interest in the hosting duties.

But according to the report Ratner has focused solely on Murphy, star of such 1980s and 1990s hit comedies as "Beverly Hills Cop," "Trading Places" and "The Nutty Professor."

An Academy spokeswoman was not immediately available to comment on Sunday. The upcoming Oscars will take place on February 26, 2012.

Murphy, whose new film with Ben Stiller opens on November 4, is reportedly interested in the job, Deadline said.

The "Saturday Night Live" alumnus was nominated for a best supporting actor in 2006 for "Dreamgirls."

(AP) ? The dismal U.S. job market, which has intensified fears of another recession, may be even worse than the unemployment numbers suggest.

The shockwaves from the Labor Department report on Friday that employers stopped hiring in August have rippled around the world, sparking a steep retreat in Asian stock markets. The lack of hiring in the U.S. last month surprised investors ? economists were expecting 93,000 jobs to be added. Previously reported hiring figures for June and July were revised lower.

The jobs picture may even be worse than the 9.1 percent unemployment rate suggests, because America's 14 million unemployed must also compete with 8.8 million other people not counted as unemployed ? part-timers who want full-time work.

When consumer demand picks up, companies will likely boost the hours of their part-timers before they add jobs, economists say. It means they have room to expand without hiring.

Fears that the U.S. economy may be stuck in neutral, or worse, slammed Asian and European stocks.

While Wall Street was closed for Labor day holiday, Japan's benchmark Nikkei 225 index fell 2 percent. Hong Kong's Hang Seng dropped 2.2 percent lower and South Korea's Kospi Composite Index tumbled 4 percent.

In Europe, Germany's DAX slumped 2.9 percent, France's CAC-40 shed 3.3 percent and Britain's FTSE 100 2.0 percent."

The problem is that there simply hasn't been any meaningful jobs growth, which is precisely why markets are so worried about slipping back into recession," said Ben Potter of IG Markets in Melbourne, Australia.

"The authorities have thrown a lot of stimulus at the problem and to date, it's basically done nothing," Potter said. Markets are realizing "that there probably isn't a lot more authorities can do."

The unemployed will face another source of competition once the economy improves: Roughly 2.6 million people who aren't counted as unemployed because they've stopped looking for work. Once they start looking again, they'll be classified as unemployed. And the unemployment rate could rise.

Intensified competition for jobs means unemployment could exceed its historic norm of 5 percent to 6 percent for several more years. The nonpartisan Congressional Budget Office expects the rate to exceed 8 percent until 2014. The White House predicts it will average 9 percent next year, when President Barack Obama runs for re-election.

The jobs crisis has led Obama to schedule a major speech Thursday night to propose steps to stimulate hiring. Republican presidential candidates will likely confront the issue in a debate the night before.

The back-to-back events will come days after the government said employers added zero net jobs in August. The monthly jobs report, arriving three days before Labor Day, was the weakest since September 2010. Reaction from U.S. markets won't be evident until Tuesday, when trading resumes after the holiday.

Combined, the 14 million officially unemployed; the "underemployed" part-timers who want full-time work; and "discouraged" people who have stopped looking make up 16.2 percent of working-age Americans.

The Labor Department compiles the figure to assess how many people want full-time work and can't find it ? a number the unemployment rate alone doesn't capture.

In a healthy economy, this broader measure of unemployment stays below 10 percent. Since the Great Recession officially ended more than two years ago, the rate has been 15 percent or more.

The proportion of the work force made up of the frustrated part-timers has risen faster than unemployment has since the recession began in December 2007.

That's because many companies slashed workers' hours after the recession hit. If they restored all those lost hours to their existing staff, they'd add enough hours to equal about 950,000 full-time jobs, according to calculations by Heidi Shierholz, an economist at the Economic Policy Institute.

That's without having to hire a single employee.

No one expects every company to delay hiring until every part-timer is working full time. But economists expect job growth to stay weak for two or three more years in part because of how many frustrated part-timers want to work full time.

And because employers are still reluctant to increase hours for part-timers, "hiring is really a long way off," says Christine Riordan, a policy analyst at the National Employment Law Project. In August, employees of private companies worked fewer hours than in July.

Some groups are disproportionately represented among the broader category of unemployment that includes underemployed and discouraged workers. More than 26 percent of African Americans, for example, and nearly 22 percent of Hispanics are in this category. The figure for whites is less than 15 percent. Women are more likely than men to be in this group.

Among the Americans frustrated with part-time work is Ryan McGrath, 26. In October, he returned from managing a hotel project in Uruguay. He's been unable to find full-time work. So he's been freelancing as a website designer for small businesses in the Chicago area.

Some weeks he's busy and making money. Other times he struggles. He's living at home, and sometimes he has to borrow $50 from his father to pay bills. He's applied for "a million jobs."

"You go to all these interviews for entry-level positions, and you lose out every time," he says.

Nationally, 4.5 unemployed people, on average, are competing for each job opening. In a healthy economy, the average is about two per opening.

If work-force dropouts had been counted as unemployed, August's unemployment rate would have been 10.6 percent instead of 9.1 percent.

The Labor Department's report relies on data collected from surveys of households and businesses in the second week of August. That's right after Standard & Poor's removed the country's AAA credit rating and fears mounted that Europe's banking crisis could spread to the U.S. Television screens were filled with images of riots in London.

"I'm not surprised that businesses weren't doing too much hiring in that environment," Jeff Kleintop, chief market strategist at LPL Financial.

Dell, Baidu team up for tablets and mobiles (Reuters)

SHANGHAI (Reuters) ? Dell Inc is partnering China's top search engine Baidu Inc to develop tablet computers and mobile phones, targeting the Chinese market now dominated by Apple Inc and Lenovo devices.

China is one of the fastest growing markets for tablets and is home to more than 900 million mobile phone subscribers. Analysts said the tie-up could be Dell's way to revive its flagging tablet business.

"I suspect this is just Dell, who has a lot of problems on the mobile and tablet front, grasping at straws to get any kind of publicity that it can to make its product more attractive," said Michael Clendenin, managing director of technology consultancy RedTech Advisors.

"Ultimately in China, I still think it is Apple's game, still for the iPad and iPhone."

Baidu is one of China's best known brands and a mobile phone or tablet carrying the Baidu name will be able to leverage on that recognition all over China, analysts said.

Dell declined to give a timeline for the launch of the devices, but local media reported on Tuesday, quoting sources, that it may be as early as November.

"We have a partnership with Baidu and you know we have the Streak 5 tablet, so the partnership will be in that space," a Dell spokeswoman told Reuters on Tuesday, adding that both companies were also cooperating on the mobile handset front.

Dell's Streak 5 tablet is a five-inch Android-based tablet that was discontinued in the United States last month.

The Dell tie-up underscores Baidu's efforts to widen its product offerings and leverage its near 80 percent share of the country's search market, the world's largest.

"All PC brands are trying to differentiate themselves from each other in the mobile space, and Dell's tie-up with Baidu may give it first-mover advantage in the China market," said Hanna Chang, an analyst with SinoPac Securities in Taipei.

Baidu launched a new mobile application platform last week and offered a glimpse of its upcoming mobile operating system which it hopes will serve a growing number of users accessing the Internet from smartphones and tablet computers.

The company said it already had partnerships with Dell and other device makers and declined to comment on the new tie-up. Dell said the partnership with Baidu involved the company's new mobile platform.

Baidu has built on its dominance of China's search market significantly since Google's high-profile exit last year citing hacking and censorship concerns.

Baidu's Nasdaq-listed shares are up nearly 50 percent so far this year, giving it a market value of around $50 billion.

BUSY SPACE

A Dell-Baidu tie-up would be the latest in a series of developments re-shaping the mobile devices market.

Last month, Google said it would acquire Motorola Mobility Holdings for $12.5 billion, in a move that will put Google into a lower-margin manufacturing business and pit it against as many as 38 other handset companies that use Google's Android software.

"Dell has got nothing to lose, they don't have a big mobile presence, so by partnering Baidu, they will probably get some momentum for their mobile products," said Sandy Shen, a research director with Gartner.

Dell has chosen China to launch new products before. In June, Dell said it had chosen to launch its new 10-inch Android tablet in China this summer, passing up on a U.S. and European launch, in a sign of the market's growing importance to the company.

Dell's China sales grew 22 percent in the first quarter while its retail presence in China exceeds 10,000 sales points.

In 2009, Dell announced it will enter the smartphone market starting in China before moving into Brazil.

Dell and Baidu's tie-up is unlikely to have an impact on Apple's quest for the hearts and minds of smartphone customers, analysts said. Technology heavyweights have failed so far to take a significant bite out of the iPad's success.

Hewlett-Packard Co said it would kill its TouchPad after just seven weeks on shelves, joining Dell's Streak 5 in the tablet graveyard. Weak sales for many offerings suggest others are likely to follow.

Remember, it?s better to keep your business assets and your personal assets as separate as possible to keep your taxes in order. ?You can get a tax id number in a few minutes at the IRS website, and start using it immediately, whether or not you?ve formed a corporation, LLC, or non profit.

Deciding when to incorporate is different for every business owner, and there are companies who do business as a sole proprietorship for the life of the company. ?However, it?s usually better to incorporate sooner than later. ?The bottom line is that you should incorporate as soon as you feel like your business could expose you to personal liability. For example, if there?s any possibility that someone could sue the business, it?s best to incorporate in order to separate your business and personal assets. ?You don?t want to lose your family home if someone slips in your store and sues you, for example.

Setting up a corporate structure at the very beginning can also help you if the company fails, so it?s best to do it before you know whether you?ll make money. ?When you?re a sole proprietorship, you and the company are inseparable, meaning that your assets (and debts) are also in the same pot. ?Forming a separate legal entity (like a corporation, LLC, or non profit) helps reduce your personal liability in case the business doesn?t turn out to be the profit-machine you?d hoped.

Finally, incorporating can help build your business?s reputation. ?Creating a separate legal entity for your business communicates credibility for your brand, and shows that you intend to be around for a while, which can actually help you make money. ?Incorporating is just one tool in your arsenal that can give you a competitive advantage, and help you become a profitable business, so the sooner the better!

Spark & Hustle: What kind of business should invest in trademarking its name--is this something every business should do? What are the general parameters of who shouldn't bother?

Rocket Lawyer: Every business should take steps to trademark their name. ?There are levels of trademark protection, and there are several initial steps that any business can take to claim trademark protections without a lot of work or money. ?Registering your trademark, which is not required, does cost money, and can take several years, although it gives you additional protection.

So what is a trademark, anyway? A trademark is defined as either a symbol, word, or words legally registered or established by use as representing a company or product.

The key phrase is ?established by use.? ?That means that you can claim trademark protection simply by using your name in commerce, and you can communicate to other companies that you?re claiming trademark protection simply by adding the ? symbol after your brand name.

That said, you must first establish a unique name, since you can?t trademark someone else?s brand or something that is too general. ?If you have the perfect name in mind, do some research to see who is already doing work in that space, and how they are different. ?The key is to avoid confusion. ?If there is someone else in your space with a similar name, it?s best to pick a different name to avoid legal issues down the road.

Once you have your unique name, incorporating your business is a smart move because it establishes your company name with an incorporation date. ?In addition, you?ll want to use the ? symbol whenever your name is in writing can help you establish your trademark.

Although it?s not necessary, it?s best to apply for trademark registration with the USPTO as soon as you can. ?A registered trademark is easier to defend from unauthorized use. ?Weigh the benefits to your company, and the costs. ?There are filing fees and it can take several years to register your trademark. ?You?ll also need to make sure no one else has already registered your trademark before you apply. It would be a waste of money to file and have your registration refused because another trademark exists or is pending, so conduct a thorough search for existing trademarks before filing a trademark on the USPTO's website. ??To that point, after you've filed your application, the USPTO will also conduct an investigation for similar marks before making a decision on your trademark.

Spark & Hustle: For someone starting a small cupcake business, what kind of legal protections should she consider?

Rocket Lawyer: Incorporate. Although it?s not fun to think about, what happens if the cupcake business isn?t successful? ?Incorporating separates the owner?s assets from those of the business. ?If the business goes broke, creditors have a much harder time coming after the owner?s house, for example, to pay the debts of the business. ?Incorporating also gives the owner tax flexibility which can save money in the long run.

Get a unique name, and take steps to trademark it. ?There are a lot of cupcake shops out there, and you need to stand out. The more unique your brand, the more you?ll stand out from the crowd.

Get contracts in writing. ?If you get a contract to supply cupcakes to a local cafe, make sure to create a contract. ?Putting the agreement in writing protects everyone?s interests and defines expectations of both parties.

Keep your trade secrets. Don?t let your secret recipe become common knowledge -- have your vendors or employees sign a non-disclosure agreement to protect your unique recipe from copycats.

Get insurance. ?If you?re opening a storefront, you?ll need liability insurance in case a customer slips and falls on some spilled frosting. ?You?ll also need workers? comp if you have employees.

Create employment agreements. ?If the cupcake business expands and you need to hire employees, it?s important to have employment contracts in place to protect you from a lawsuit.

Spark & Hustle: If the domain name I want for my business is taken, how can I go about getting it -- or should I give up and pick another name?

Rocket Lawyer: If your domain name is already taken, it?s probably easier to pick a new one that is available. ?There?s no guarantee that the current owner will give it up, and if the current owner does want to sell, it could still cost you a pretty penny -- and that?s not a cost most small business owners want to incur when they?re just starting out.

If you have your heart set on a particular domain name that?s not available, you can use a site like Whois.com to find the information on the domain. You can make an offer to the current owner and hope that they will negotiate with you.? If the current owner is unwilling to part with their domain, you will have no choice but to pick a modified version of that name (if available), or choose a new name altogether.

Spark & Hustle: Are there any situations where verbal agreements are suitable, or must everything be documented in writing when starting a business?

Rocket Lawyer: When in doubt, you should put it in writing. ?It is difficult to prove the terms of a verbal agreement, and can lead to a ?he said, she said? argument that won?t stand up in court.

TB relative could be new vaccine

Injecting modified bacteria related to those which cause tuberculosis could protect against the lung disease, US scientists say.

Experiments on mice showed the injections could completely eliminate tuberculosis bacteria in some cases, Nature Medicine reports.

The only TB vaccine - the BCG jab - is not very effective.

The research is in its early stages and the potential for a human vaccine is unknown, campaign group TB Alert says.

Tuberculosis is caused by Mycobacterium tuberculosis. It is one of the top 10 leading causes of death, according to the World Health Organization, killing 1.7 million people each year.

The BCG vaccine has variable results. It has been shown to be between 0% and 80% effective in different parts of the world.

Researchers at the Albert Einstein College of Medicine in New York were investigating a cluster of genes called esx-3, variants of which are in all types of Mycobacterium and help the organisms evade the immune system.

Mycobacterium tuberculosis cannot survive without its esx-3 genes but its relative, Mycobacterium smegmatis, can.

Scientists deleted the genes from M. smegmatis and injected an otherwise deadly dose into mice. Within three days the mice had cleared the bacteria from the lungs and kidneys.

The research team then tried putting the esx-3 genes from M. tuberculosis into M. smegmatis, which they then called Ikeplus.

Mice were still able to rapidly clear an Ikeplus infection but it seemed to leave a lasting immunity against M. tuberculosis.

Survival

In mice infected with the TB bacteria, those which received no vaccine died after 54 days on average.

Those vaccinated with BCG lasted 65 days, while mice immunised with Ikeplus survived for 135 days.

In the mice which survived the longest, more than 200 days, researchers were no longer able to detect the deadly bacteria.

Lead researcher Prof William Jacobs said: "We consistently protected mice better with Ikeplus than with BCG.

"This is something we've dreamed about for years, to be able to get longer protection and bactericidal immunity."

He warned that only 20% of the mice were long-term survivors so the vaccine would need further development.

He added: "Ikeplus is different from any other TB vaccine and it's a new tool for the TB arsenal."

A TB Alert spokesperson said: "These are interesting experiments but it is too early to tell what impact they will have on the development of a safe and effective vaccine."
